DHA Landscaping Incentive:
1. Defence Housing Australia (DHA) is offering a landscaping incentive (DHA Landscaping Incentive) to assist in paying for landscaping services in the front (street facing) yard for a select number of land lots (the applicable lots) at Torhaven, Deebing Heights (Torhaven).
2. As part of the DHA Landscaping Incentive, the following may be included to an applicable lot purchased by the buyer, to a maximum retail value of between $5,500 and $8,500 including GST, with the applicable amount determined by DHA in its sole discretion depending on the lot size, the width of the front yard, and any other factors DHA deems relevant: turf/grass to the front (street facing) lot boundary; plants, grass bed/s; garden edging; mulch and/or gravel; a consultation with a landscape designer; an individual landscape design; and/or labour and machinery hire, with the works to be performed by contractor/s nominated by DHA, but does not include any works or improvements to any part of the applicable lot that is not the front (street facing) yard, fences, driveways, footpaths, retaining walls, letterboxes, or turf/grass to the front footpath/nature strip.
3. Buyers of an applicable lot may add extra improvements at their own cost, however they cannot subtract from the package offered.
4. The landscaping works required as part of the DHA Landscaping Incentive will be completed within 6 months of approval by DHA of the buyer’s Application.
Eligibility Criteria:
5. The DHA Landscaping Incentive:
5.1 is only available for the applicable lots, being a select number of land lots at Torhaven, as determined by DHA in its sole discretion and communicated to a prospective buyer;
5.2 is only available to buyers who:
5.2.1 sign a contract of sale with DHA for the purchase of an applicable lot on or after 13 March 2020 and for which settlement occurs on or before 30 June 2020;
5.2.2 achieve practical completion of the building of their dwelling on the applicable lot and are issued with a Certificate of Occupancy on the applicable lot;
5.2.3 have installed all fencing on the applicable lot;
5.2.4 reinstated the turf to the footpath on the applicable lot;
5.2.5 have removed all building materials and waste from the applicable lot (including gravel and other obstructions) and make it level (with any necessary retaining installed);
5.2.6 have constructed the dwelling on the applicable lot consistent with the Torhaven Design Guidelines; and
5.2.7 satisfy any other requirement reasonably imposed by DHA,
to a standard approved by DHA in its sole discretion.
5.3 must be applied for by the buyer, after satisfying all eligibility criteria outlined in these Terms and Conditions, in accordance with clause 5, on or before the date which is 12 calendar months from the settlement of the applicable lot, and by no later than 30 June 2021;
5.4 cannot be combined with any other promotion, discount or offer, and cannot be transferred or assigned to a third party in any circumstances, including in the event of the land being on-sold by the original buyer;
5.5 is not available to any buyer who is or has been in breach of any provision of the Contract of Sale for the purchase of the applicable lot either before or after settlement of the purchase;
5.6 may be cancelled if the nominated landscaping contractor is not provided with access to the applicable lot by the buyer to enable installation to commence or be completed; and
5.7 cannot be exchanged for cash or monetary value.
6. DHA reserves the right to:
6.1 request further information and/or evidence from a buyer for the purposes of satisfying itself whether the eligibility criteria have been met by a buyer;
6.2 determine in its sole discretion whether or not a buyer meets the eligibility criteria, and therefore, whether or not they are eligible to receive the DHA Landscaping Incentive; and
6.3 cancel or make changes to these Terms and Conditions without notice.
7. DHA accepts no responsibility for any loss, damage, cost or expense (whether direct or indirect) suffered or incurred by a buyer as a result of or in connection with the DHA Landscaping Initiative. This disclaimer does not attempt or purport to exclude liability arising under statute or law if, and to the extent, such liability cannot be lawfully excluded.
Application for the DHA Landscaping Incentive by the Buyer:
8. Buyer/s of the applicable lot can apply for the DHA Landscaping Incentive by:
8.1 selecting a landscaping package from a set range of designs in the Torhaven Landscaping Design Options document here; and
8.2 completing the Torhaven Landscaping Application Form found here, supplying the documentation requested and emailing it to torhaveninfo@oliverhume.com.au on or before the date which is 12 calendar months from the settlement of the applicable lot, and by no later than 30 June 2021.
9. A DHA representative will then contact the buyer to discuss further information regarding the DHA Landscaping Incentive and to coordinate installation of the landscaping package.
10. Once installed, the buyer shall be responsible for all future maintenance and upkeep of the landscaping and front yard.
